Terms of Service

01Eligibility

• You must be at least 18 years of age to register on the Platform.
• By registering, you represent that you are legally capable of entering into binding contracts under Indian law.
• One account per individual. Multiple accounts may result in termination of all associated accounts.

02Account & Roles

The Platform supports multiple roles:

• User — Basic registered account. Can browse, book homestays, book guides, and join journeys.
• Quiet Member — Verified community member (requires KYC). Can create and lead journeys, earn commission.
• Guide — Certified local guide. Can accept guide bookings from travelers.
• Homestay Owner — Property owner. Can list and manage homestay properties.

You are responsible for maintaining the confidentiality of your login credentials. Notify us immediately at support@quietsummit.in if you suspect unauthorized access.

03Quiet Membership & KYC

To become a Quiet Member, you must complete our KYC verification process, which includes:

• Government-issued photo identification document
• A clear selfie for identity verification
• Bank account details for commission payouts

Submission of KYC does not guarantee approval. Providing false or fraudulent documents will result in immediate and permanent account termination and may be reported to relevant authorities.

04Bookings & Payments

• All prices are displayed in Indian Rupees (INR).
• Payments are processed securely through Razorpay. QuietSummit does not store your card or UPI details.
• For journeys: a registration fee is collected at booking. The remaining balance is collected before the journey start date.
• For homestays and guide bookings: full payment is collected at the time of booking.
• Bookings with unpaid balances past the deadline will be automatically cancelled.
• All successful transactions generate a digital receipt accessible from your bookings dashboard.

05Journey Terms

For Travelers:

• Joining a journey constitutes acceptance of its specific terms, itinerary, difficulty level, and physical requirements.
• If a journey does not meet its minimum participant threshold, it may be cancelled with full refunds to all booked travelers.

For Journey Creators (Quiet Members):

• You are responsible for the accuracy of journey details including itinerary, difficulty, inclusions, exclusions, and pricing.
• Cancellation of a published journey by the creator will result in full refunds to all booked travelers and may affect your platform standing.
• Commission is earned on successful journey completion and is subject to the dispute window period.

06Homestay Terms

For Travelers:

• You agree to treat the property with respect and follow any house rules communicated by the owner.
• Damages to property may result in additional charges.

For Homestay Owners:

• Your listing must accurately represent the accommodation, amenities, and facilities available.
• Properties must pass QuietSummit's verification process before being listed.
• You must honour confirmed bookings. Repeated cancellations may result in listing suspension.

07Guide Terms

For Travelers:

• Guide bookings are subject to the guide's availability and acceptance.

For Guides:

• You must maintain valid certifications and provide accurate profile information.
• Accepted bookings must be honoured. Cancellation after acceptance may result in penalties.
• You are responsible for the safety of travelers during your engagement.

08Cancellation & Refunds

• Each booking type has its own cancellation policy, clearly displayed at the time of booking.
• Registration fees for journeys are non-refundable unless the journey is cancelled by QuietSummit or the creator.
• Refunds are processed to the original payment method within 7–10 business days.
• No-show may result in zero refund as per the applicable policy.

09Disputes & Settlements

• A 72-hour dispute window begins after a journey or homestay stay is completed before earnings are settled.
• Disputes are reviewed by the QuietSummit team. The admin's resolution decision is final and binding.
• If no dispute is raised within the window, the settlement proceeds automatically.

10Commission & Earnings

• Quiet Members earn performance-based commission on successful journey completions.
• All settlements are transferred to the bank account registered in your profile.
• QuietSummit is not liable for failed settlements caused by incorrect bank information provided by you.

11Community Guidelines

• Prohibited content includes: hate speech, harassment, spam, misleading information, explicit content, and promotion of illegal activities.
• Violations may result in content removal, suspension, or permanent account termination.
• You retain ownership of content you post but grant QuietSummit a non-exclusive, royalty-free license to display it on the Platform.

12Ratings & Reviews

• Reviews must be honest, based on genuine experience, and free from manipulation.
• Offering or accepting incentives for reviews is prohibited.
• QuietSummit reserves the right to remove reviews that violate these guidelines.

13Adventure & Risk Acknowledgment

By participating in any journey, trek, or guided activity, you expressly acknowledge:

• Inherent Risks: Mountain travel involves risks including altitude sickness, hypothermia, falls, rockfall, avalanches, flash floods, and adverse weather.
• Physical Fitness: You confirm you are in adequate physical health for the activity as described, including its stated difficulty, altitude, and duration.
• Remote Locations: Many activities take place where immediate medical assistance or evacuation may not be available. Helicopter rescue, if required, is at your own expense unless explicitly included.
• Weather & Route Changes: Itineraries may be altered or cancelled due to weather or safety concerns. Such changes do not constitute a breach of service.
• Travel Insurance: QuietSummit strongly recommends comprehensive travel and medical insurance covering high-altitude trekking and emergency evacuation.
• Assumption of Risk: You voluntarily assume all risks. QuietSummit shall not be held liable for injury, illness, death, or damage arising from participation, except in cases of proven gross negligence.

14Limitation of Liability

• QuietSummit operates as a marketplace connecting travelers with service providers. We are not the direct provider of accommodation, guiding, or travel services.
• Our total liability for any claim shall not exceed the amount you paid for the specific booking in question.
• We are not liable for losses arising from force majeure events including natural disasters, pandemics, or government actions.

15Intellectual Property

• All Platform content (design, code, branding, text) is owned by QuietSummit Private Limited.
• User-uploaded content remains your property, but you grant us a worldwide, non-exclusive, royalty-free license to use and display it on the Platform.
• Scraping or automated data collection without written permission is prohibited.

16Account Termination & Data Retention

• You may request account deletion at any time through your profile settings.
• Upon deletion, your personal data will be anonymized. However, financial records are retained permanently as required by Indian tax and audit compliance laws.
• QuietSummit reserves the right to suspend or terminate accounts that violate these Terms.

17Modifications to Terms

QuietSummit reserves the right to modify these Terms at any time. Material changes will be communicated via email or in-app notification at least 7 days before taking effect. Continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.

18Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Gwalior, Madhya Pradesh, India.
